Rules and Guidelines for the 2005 Online Charity Auction

Please review the rules and guidelines prior to bidding.

Schedule of this auction: The auction will run for 1 week.

Start: Saturday, November 12th, 2004, at 12:00:00 PM PDT (that will be 3:00:00 PM EDT).

End: Saturday, November 19th, 2004 at 1:00:00 PM PDT (that will be 4:00:00 PM EDT)

**The times are based upon the message board's automatic time stamp. The message board's time stamp
may not be absolutely accurate, but this is the time we are going by, so please set your clock by it. **

Bidding: It is extremely important that you provide a valid e-mail address. YOU MUST PROVIDE YOUR EMAIL ADDRESS IN YOUR POST FOR YOUR BID TO BE VALID. All bidding will be made in American dollars; however bidding is open to everyone and we can ship internationally. You must be 18 or older to bid.

Bid Increments: Bids must be made in increments of $1.00. If you raise a bid by any amount other than a
$1.00 increment, the previous bid prevails until the bidding has raised the item price by a $1.00 increment. Example: The bid is at $20. You may bid $21 or $22 or $23, and so on.

IMPORTANT BIDDING RULE: The last officially accepted bids must be placed no later than 1:00:00 PM PDT (that will be 4:00:00 PM EDT). For example, a bid placed at 1:00:45 PM PDT will not be valid.

NO BID WITHDRAWALS PLEASE! If you bid, you need to honor that bid. (Editing of bid posts has been
disallowed.) Bid only for yourself. You can't give your bid to someone else.

Registration: If you are already registered for the MB you do not have to register again. You will need to
register for this message board to place bids. There is a link to "register" in the upper right of your
screen. Please click on that link and follow the directions. The only information you are required to
enter is your screen name/code name and a valid e-mail address. Anything else is optional. Your IP number is
logged by the board but is not on display to the public. You will then need to use the screen name and
the password you chose each time you post to the auction board. If your browser accepts cookies, the
board can save your login information for you if you choose that option. If you have already registered for
an EZboard Global account, you do not need to repeat the process.

Internet Difficulties: The Internet is an unstable medium. You may experience difficulties or delays in
posting due to problems that may emanate from your ISP/computer or ours. We will make every effort to
ensure that the board operates as efficiently as possible; however by participating in this auction you
agree not to hold liable Jessica Smith, Eric Etebari, Hollygrove, Mercy Corps or any other associated entity
in the event that your bidding is hampered by technical difficulties.

As-is policy: All items are offered as-is. I will note wherever possible if they are in less than excellent
condition but we make no guarantees. Please view the items and feel free to ask questions. The auction is
not responsible for items that are lost or damaged in shipping.

Payment Methods: Payment for winning bids can be made with personal checks, cashier's checks, or money
orders. You will be notified of shipping costs (priority mail with signature confirmation) when you
receive confirmation of your winning bid. If you live outside the U.S. shipping costs will be higher.

Payment Instructions: You will be contacted by Jessie (la_femme_fanatic@yahoo.com) with payment instructions in a timely manner after the ending of the auction. Please be patient.

Payment Received: Payment must be received within 1 week of receiving payment instructions.

Rights to Auction Items: If I do not receive payment within 2 weeks of the closing date of the auction, you
forfeit your rights to the auction item(s). The auction has the right to offer the item(s) to the next highest bidder if payment is not received within 2 weeks of the auction close date.

No Overhead: 100% of your bid will be donated to the charity. There is no administration cost. This means
that the bidder is responsible for payment for shipping the auction items to you. There is no
handling fee. Bidders agree to pay priority mail with confirmation delivery if they win an auction item.

Charity Information – Who will you be making a donation to? 50% of the auction amount will go to
Eric’s Charity of Choice, Hollygrove (www.hollygrove.org). 50% of the auction amount will
go to Mercy Corps (www.mercycorps.org) to benefit Katrina victims. If you win an item, you will be
making a 50/50 donation to Hollygrove and Mercy Corps.

Disclaimer This event is to raise funds for charities. The fundraising team will NOT make a profit and we are
not associated with any other organization.
